Bananas!* stämmer Dole

Bananas!* regissör Fredrik Gertten meddelar idag att man stämt Dole.

Uppmärksammade filmen Bananas!* har blivit stämd av Dole Food Company. Nu har personerna bakom filmen stämt Dole för att Dole försökt stoppa yttrandefriheten genom sin stämning.

Ur ett pressmeddelande från advokatfirman Lathrop & Gage vi precis mottog:

In response to a defamation lawsuit brought by Dole Food Company, Inc. against the makers of the documentary film BANANAS!*, attorneys for filmmakers Fredrik Gertten, Margarete Jangård and WG Film today filed a Motion to Strike Dole’s Complaint under California’s Anti-SLAPP statute, which allows the court to dismiss meritless lawsuits filed for the purpose of stifling protected speech.

Förutom att genom detta drag försöka stoppa Doles stämning försöker man nu också få ersättning för den skada Dole orsakat filmen Bananas!*.

Fredrik Gertten om läget:

– Vi är nöjda med att sanningen om vår film till slut kommer att bli känd och att allmänheten kommer att se att Doles stämning var bara ett försök av Dole att tysta den offentliga diskussionen av viktiga frågor.

Gerttens jurist Lincoln Bandlow säger så här:

If there ever was a lawsuit that cried out for the speech-protecting mechanism of California’s Anti-SLAPP statute, it is Dole’s absurd defamation action. We are confident that once the Court sees the actual film, rather than Dole’s patently false description of it in the complaint, this action will be summarily dismissed, my clients can proceed with the film’s distribution and seek to recover the damages suffered by Dole’s censorship-by-intimidation tactics.
